Personal Injury

Wills, Estates, and Trusts

We have a department totally dedicated to Wills, Estates, Trusts and Estate Litigation.  It is our experience that many people in need of guidance surrounding Wills, Estates and Trusts may have disability issues and we regularly do home visits, or visits at nursing homes and hospitals.

We always start the process with an initial appointment, when we will discuss the following:  Will preparation, Power of Attorney, and Health Care Directives.  Once we have had a discussion surrounding your Estate plan the documentation is then prepared and an appointment set to come back for the signing of the documents.

Unhappily, there are occasions when disputes arise surrounding the Execution of Wills, distribution of Estates and there is an Estate challenge.  We have lawyers on staff, who are experienced in Estate Litigation and will provide representation in the Litigation process if this should become necessary.

Civil Litigation

Our goal is to represent our clients in disputes that may require court intervention in multiple areas of law, including:

• Labour Law – We represent both employee and employers in drafting employment contracts as well as representing parties in employee termination and wrongful dismissal;
• Real Property Law – disputes over ownership of parcels of land, boundary line disputes, and disagreements over the existence of easements and rights of way;
• Estate Litigation – disputes regarding the validity of a will based on mental incapacity, improperly executed wills, and wills drafted under undue influence. We also assist our clients if a personal representative for the estate fails to make an application to probate, and/or fails to adequately manage an estate due to negligence, illegal activity or misrepresentation. Additionally, if you are a spouse, or child of a deceased person, and were not adequately provided for in the will, you may have rights depending on the circumstances.
